Albay 1st District Representative Edcel Lagman, Akbayan Representative Tom Villarin, and Magdalo Representative Gary Alejano have expressed their intention to file accusations of accusation against Supreme Court justices
MANILA, Philippines – Opposition lawmakers want to dismiss the 8 Supreme Court (SC) judges who voted to overthrow Maria Lourdes Sereno as president of the court.
Albay 1st district representative Edcel Lagman, representative of Akbayan Tom Villarin and representative of Magdalo Gary Alejano issued separate sentiments expressing his intention to file accusations against the following judges:
- Associate Judge Teresita Leonardo-de Castro
- Associate Judge Diosdado Peralta
- Associate Justice Lucas Bersamin
- Associate Justice Francis Jardeleza
- Associate Justice Samuel Martires
- Associate Justice Noel Tijam
- Associate Judge Andres Reyes Jr
- Associate Justice Alexander Gesmundo
] His planned accusation against members of the Supreme Court comes days after the SC voted 8-6 to grant the petition of quo warrantp nullifying the appointment of Sereno.
In a statement on Friday, May 18, Lagman said that "the immutable rule is that injustice does not pay."
"If the magistrates who have sworn to uphold the Constitution subvert the fundamental law by asserting their jurisdiction over an impeccable official, they deserve to be accused," Lagman said.  He said that the 8 judges are "responsible" for the culpable violation of the Constitution and the betrayal of public trust for agreeing to eliminate Sereno via quo warranto.
The 1987 Constitution only permits the dismissal of imputable officials such as the chief jusice through indictment by the House of Representatives, and then conviction by the Senate, sitting as an indictment court.
"No other procedure is allowed, certainly not an aberration of a quo warranto action," Lagman said.
Lagman's block in the House is ready to release his statement on the impeachment charges planned against the SC judges on Tuesday, May 22.
The list of the party Magdalo de Alejano, who previously presented the ruling im a peach complaint against President Rodrigo Duterte, believes that the trial of the 8 judges is the best way to save the integrity of the judiciary.
"We firmly believe that the filing of indictments against the judges is the only viable remedy to correct this error and save the integrity of the Supreme Court before the Filipino people," Magdalo said in a statement.
"As opposed to what the judges had exercised, we want to follow the legal path based on what is foreseen in the Constitution," the statement added.
Will the planned impeachment complaints win public support? Villarin thinks so.
"This plan to bring an impeachment accusation against the 8 judges will gain ground in the coming days because I believe that civil society groups, including groups of lawyers, and those of the private sector will also support this measure," he said. However, most legislators in the House are in favor of Duterte, who publicly declared Sereno as his "enemy" and told Congress to accelerate the accusation against her. .
The House's justice panel also approved the articles of the accusation against Sereno after holding hearings for months.
