Erie County, NY (WKBW) – Supreme Court Judge Henry Novak announced Wednesday restaurants in Erie County, which sued the state due to orange zone restrictions, with a permanent ruling due next week to temporarily indoor food Can be reopened.
Those restaurants must operate under yellow zone restrictions as per the judge’s ruling, which allows indoor and outdoor dining with a maximum of four people per table.

Thirty-seven restaurants filed a lawsuit against state governor Andrew Cuomo and other legislative and health officials over the Orange Zone closure on December 27. The list quickly grew to over 90 restaurants.
“It’s about looking at the customer, it’s about seeing your customers interacting with your employees, especially regularly,” said Paul Sentora, owner of Santora’s Pizza Pub and Grill Restaurant. . “
In his ruling, Judge Novak wrote in part, “Looking at the record presented, this court cannot provide evidence that the state has a rationale for designating parts of Erie County as the Orange Zone on November 18, 2020 Was the basis. “
He also said that the restaurant exhibited the orange zone due to loss of residents, unemployment and revenue.
January 9, the state and the restaurant presented their cases in court. Judge Novak said he would need additional time to decide. Hoganwillig’s lawyers representing the restaurant asked the state determined in June to reopen the restaurant under the same guidance. State attorneys said they are relying on CDC guidance, classifying indoor food as high risk.
On December 28, New York State Supreme Court Judge Novak stated that the state should compromise COVID-19 restrictions on bars and restaurants. Neither the state nor the restaurant were willing to compromise.
Lawyers for HoganWillig said it is unconstitutional for the governor to shut down indoor dining. The lawyers said that it infringed on the rights of the owners so that honest living could be done.
On December 11, during his press briefing, Governor Cuomo stated that bars and restaurants, statewide, accounted for only 1.43% of COVID-19 cases. Cuomo stated that 73.84% of COVID-19 cases come from domestic or social gatherings.
Lawyers said that the government could not stop indoor dining because it has been statistically shown that restaurants are not the cause of COVID-19 proliferation.
State representatives said they sympathize with the restaurant’s financial losses, but are in favor of saving lives. The state stated that not allowing indoor food is one way to prevent the spread of COVID-19.

Restaurants not named in the lawsuit in the Orange Zone will still be closed for indoor dining.
“The court ruling only applies to our customers,” said Corey Hogan, partner at Hoganwillig, “I don’t know what the Governor’s intentions will be now that maybe 80 restaurants in Erie County will open and many more won’t be allowed. to operate.”
A state spokesperson told 7 Eyewitness News that it was reviewing the decision.
The next step is a court hearing on Tuesday, before the judge decides whether that decision will be permanent.
