The request came in the form of a petition that Samuel D. Ingham III filed in Los Angeles Superior Court on Tuesday night.
Jamie Spears has been the curator of both her person and her estate since 2008. Montgomery has served as the singer’s temporary curator since the elderly Spears stepped aside due to health concerns in September 2019.
In the filing, obtained by CNN, Ingham cites an order filed on October 10, 2014 that determined that Britney Spears had an “inability to consent to any form of medical treatment” as the reason Montgomery should assume guardianship. total.
CNN reached out to Ingham on Wednesday asking him to explain why the singer cannot make medical decisions. Ingham stated that he “cannot comment on a pending case.”

The presentation asks that, in addition to monitoring Spears’ medical decisions, Montgomery be able to “restrict and limit visitors by any means” except to meet with Ingham. He also asks that Montgomery be able to “hold onto Spears’ caretakers” and “security guards.”
The singer’s father was first appointed by the court as guardian of his daughter’s estate, along with attorney Andrew Wallet, in 2008, after a series of personal problems that came to light for the singer. For most of that period, he also monitored his health and medical decisions. Jamie Spears became the sole conservator of the singer’s $ 60 million inheritance in 2019, following Wallet’s resignation.
Ingham filed the first application to officially remove Jamie Spears as curator last August. In November, the judge ruled that Spears would remain as co-conservator of the estate, but appointed the Bessemer Trust to act as co-conservator.
